1. Prices and Payment
(1) Our catalog and e-shop prices are subject to change and not binding. Cumulus reserves the right to make changes. Nothing contained in the catalog or e-shop shall be held to constitute a guaranteed attribute. Orders become binding if they are confirmed by us in writing or we deliver the goods.

2. Prices
(2) Prices are ex Zürich. Value added tax is included.

3. Invoices are due 30 days after receipt without deduction and payable in one sum.

4. The customer is behind schedule automatically if the payment is not made 30 days after receipt of the Invoice. In case of default we will charge the legal interest.

5. Delivery shall take place uninsured and at the customer`s risk. The risk shall pass at the latest when the goods are consigned. This applies also where part deliveries are made.

6. Cumulus reserves the right to choose the delivery method and route at its descretion unless specific instructions are given by the customer. Part - deliveries are permissible.

7. Until payment of the purchase price the sold goods remain our property.

8. The Customer is obliged to immediately inspect delivered goods upon receipt for transport damages and other defects.

9. Computer programs are not subject to change, unless they are in its original package and sealed.

10. It is not permissible to store, keep or use the Software with more than one hardware at the same time. The software, especially Jeppesen Software may not be used within networks or other multistation computer systems if this comprises the possibility of a multiple use of program at the same time. On change of the hardware, the user must delete the software from the previously used hardware.

11. The sale of goods contract entered into with the customer as well as these general terms of sale and all rights and obligations arising thereof are governed by swiss law.

12. The place of performance for all obligations arising out of this contract is Hirschthal.

13. Return & Order Policy: All items shipped outside Switzerland are NON-returnable; all freight, shipping & handling costs and customs charges are NON-refundable.

1. Unsere E - Shop Informationen und E - Shop - Preise sind freibleibend und nicht bindend. Cumulus behält sich Änderungen vor. Die Angaben im E-Shop sind keine zugesicherten Eigenschaften. Bestellungen sind für uns erst verbindlich, wenn wir sie schriftlich bestätigen oder Ihnen durch Übersendung der Waren nachkommen.

2. Die Preise gelten ab Zürich und sind inklusive Mehrwertsteuer.

3. Unsere Rechnungen sind ohne Abzug nach 30 Tagen fällig und zahlbar rein netto in einer Summe.

4. Der Kunde gerät automatisch in Verzug, wenn der Betrag 30 Tage nach Zugang der Rechnung nicht beglichen ist. Im Verzugsfalle werden die gesetzlichen Verzugszinsen erhoben.

5. Der Versand erfolgt unversichert auf Gefahr des Kunden. Die Gefahr geht spätestens mit der Absendung der Ware auf den Kunden über. Dies gilt auch, wenn Teillieferungen erfolgen.

6. Cumulus bestimmt die Versandart und den Versandweg nach pflichtgemässem Ermessen, soweit keine besondere Weisung des Kunden vorliegt. Teillieferungen sind zulässig.
Die Fracht - und allfällige Zollkosten gehen zu Lasten des Kunden. Alle Ware die nach dem Ausland versandt wird, kann nicht mehr zurück genommen werden. Alle Fracht und Handling - sowie allfällige Zollkosten sind nicht rückerstattbar.

7. Bis zur vollständigen Bezahlung des Kaufpreises bleiben die verkauften Waren unser Eigentum.

8. Der Kunde hat die gelieferte Ware bei Eingang unverzüglich auf Transportschäden sowie auf Mängel zu untersuchen.

9. Auf Software - Programmen besteht kein Rückgaberecht, ausser in original Verpackung und ungeöffneten CD-Couverts.

10. Erfüllungsort und Gerichtsstand ist Hirschthal.
